1. Scope of Application
These General Terms and Conditions (AGB) apply to all deliveries made by Dark-Lux.com to the consumer.
A consumer is any natural person who concludes a legal transaction for a purpose that can be attributed predominantly neither to their commercial activity nor to their own independent professional activity.

3. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to order.
By clicking on the purchase confirmation "Buy/Order at cost," you make a binding order for the goods listed on the order page.
Your contract of sale is concluded when we accept your order via a confirmation email immediately after receiving it.
Please note that during the ordering process, you are required to enter an e-mail address to which you have access.
4. Prices & Packaging
The prices listed in the offer at the time of ordering apply. These are final prices and include the value-added tax applicable by law in Germany.
For items that were on special offer at the time of purchase or for which a voucher has been redeemed, the reduced price is included in the final order offer.
Packaging becomes the customer's property from the moment of delivery.
5. Payment
By default, we offer the following payment methods: cash in advance, SEPA direct debit, credit card, PayPal, Google Pay, and cash on pickup.
We reserve the right to refuse certain payment methods for any order and to refer you to the available payment options.

If you select the payment method "cash in advance," we will provide our bank account details via a separate email and ship the goods upon receipt of payment.

By submitting your order, you grant us a SEPA direct debit mandate.
We will inform you regarding the date of the charge to your account (so-called pre-notification). Upon submission of the SEPA direct debit mandate, we request our bank to initiate the payment transaction.
The payment transaction is automatically processed and your account is debited. The charge to your account takes place prior to shipment of the goods. The deadline for the pre-notification regarding the date of the charge (pre-notification period) is 1 day.

You pay directly during the ordering process by entering your credit card details.
Upon dispatch of the goods, your credit card will be charged with the actual invoice amount after deduction of any applicable discounts and vouchers.
For goods that are specially manufactured according to customer specifications or clearly tailored to individual needs, your credit card will be immediately charged with the actual invoice amount.
PayPal
PayPal
You pay directly via your PayPal account. After sending your order, you will be redirected to PayPal where you enter the order value.
As soon as our PayPal account is informed of your authorization, dispatch takes place. Your PayPal account will be immediately debited upon successful authorization with the actual invoice amount.
Google Pay
Google Pay
If you choose the payment method "Google Pay," the payment processing takes place via the Google Pay application on your mobile device using a payment instrument stored there.
For payment processing, the information required within the ordering process is transmitted to Google. Subsequently, Google transmits us a transaction number for payment confirmation.

Cash on Pickup

You pay the invoice amount in cash upon pickup.
Please note that we only accept payments from accounts within the European Union (EU). Any costs associated with the money transfer shall be borne by you.
6. Vouchers and Codes and Their Redemption
Vouchers can only be used for the purchase of items on our website with a minimum order value of at least €10.
If the balance of a voucher is insufficient to cover the order, the difference may be paid using the offered payment methods.
Vouchers can only be redeemed after the order has been completed. The balance of a voucher cannot be exchanged for cash.
7. Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason for doing so.
The period for exercising your right of withdrawal is fourteen days from the day on which you or a third party you have designated, who is not the carrier, took possession of the goods or had them taken into their possession.
In order to exercise your right of withdrawal, you must notify us in an unequivocal manner of your decision to withdraw from this contract. This notification may be made by letter, fax or e-mail.
It will suffice for the purpose of preserving your period for exercising your right of withdrawal that you send the notification of exercising your right of withdrawal before the expiry of said period.

If you withdraw from this contract, we shall reimburse all payments you have made to us without delay and, at the latest, within fourteen days from the day on which our receipt of your notification of withdrawal becomes known to us.
For that purpose, we will use the same means of payment as you used for the original transaction, unless otherwise agreed with you.
We may refuse reimbursement until we have received the goods or until you provide proof that you have sent them back.
You shall return or hand over the goods to us without delay and in any event within fourteen days from the day on which you notify us of your withdrawal from this contract.
You are responsible for the direct costs of returning the goods.
You will only be liable for any loss in value of the goods if such loss is attributable to handling them beyond what is necessary to check their condition, characteristics and functioning.
8. Right to Return Goods Voluntarily
In addition to the statutory right of withdrawal described above, we offer you a voluntary right of return for a period of up to 14 days from receipt of the goods.
You may also terminate the contract after the expiration of the 14-day statutory period by returning the goods to us within 14 days of their receipt.
The prerequisite is that the goods are complete, in original packaging, unused and undamaged, and do not belong to the categories of return articles excluded by law pursuant to § 312g BGB.
The voluntary return guarantee offered by us does not affect your statutory rights and claims. In particular, your statutory right of withdrawal and your statutory warranty rights remain fully intact.

Shipping costs are waived for orders over €90.
11. Retention of Title
Until full payment has been received, the goods remain the property of Dark-Lux.com.
12. Liability
We are liable without limitation for intent and gross negligence, as well as in accordance with the provisions of the Product Liability Act.
In cases of slight negligence, we are generally only liable for injuries to life, body, or health of persons.
To the extent that liability for slight negligence may also apply, we are only liable if essential contractual obligations have been violated. Essential contractual obligations are those whose fulfillment makes the proper performance of the contract possible and on which the contracting partner can regularly rely.
Liability for violation of essential contractual obligations is limited to typical, foreseeable damages arising from the contract.
This limitation of liability also applies in favor of our performance assistants.
